The Secretary of State makes these Regulations in exercise of the power conferred by section 170(5) of the Building Safety Act 2022( 1).
1. These Regulations may be cited as the Building Safety Act 2022 (Commencement No. 2) Regulations 2022.
2. Sections 126 to 129 of the Building Safety Act 2022 (building industry schemes and prohibitions on development and building control) come into force on 1st September 2022.

These Regulations are the second commencement regulations made under the Building Safety Act 2022 (c. 30)(“ the Act”).
Regulation 2 brings into force sections 126 to 129 of the Act on 1st September 2022. The effect is to commence the powers relating to a scheme for developers and the prohibitions on developing land and building control which may be imposed on persons, including on persons who are eligible to be a member of a scheme established under section 126 but who are not members.
