EUROPEAN COMMUNITIES (FISHERY LIMITS) REGULATIONS, 1973. |

I, MARK CLINTON, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby make the following regulations: |
||
1. These Regulations may be cited as the European Communities (Fishery Limits) Regulations, 1973. |
||
2. These Regulations shall come into operation on the 1st day of July, 1973. |
||
3. In these Regulations-- |
||
"baseline" has the meaning specified in section 4 of the Maritime Jurisdiction Act, 1959 (No. 22 of 1959); |
||
"exclusive fishery limits of the State" has the meaning specified in Section 6 of the Maritime Jurisdiction Act, 1959 , as amended by section 2 of the Maritime Jurisdiction (Amendment) Act, 1964 (No. 32 of 1964); |
||
"specified fishing" means fishing specified by Article 4 (1) of the Maritime Jurisdiction (Amendment) Act, 1964 (Specified States) Order, 1965 ( S.I. No. 198 of 1965 ), and Part II of the Schedule to that Order as amended by Article 2 of the Maritime Jurisdiction (Amendment) Act, 1964 (Specified States) (Amendment) Order, 1967 ( S.I. No. 14 of 1967 ); |

"statutory prohibition" means the prohibition on fishing by means of a foreign sea-fishing boat imposed by section 222 (1) of the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959). |

4. Fishing by the fishing vessels of other Member States in the exclusive fishery limits of he State shall be a contravention of the statutory prohibition except in the following cases: |
||
(a) fishing in so much of the portion of the exclusive fishery limits of the State specified in Part I of the Schedule to these Regulations as lies outside a line every point of which is at a distance of six nautical miles from the nearest point of the baseline; |
||
(b) fishing, not being fishing for crustaceans or molluscs (shellfish), in so much of the portion of those limits specified in Part II of that Schedule as lies outside a line every point of which is at a distance of six nautical miles from the nearest point of the baseline; |
||
(c) specified fishing. |

From Cork Harbour to Carnsore Point between a line drawn in true direction South from a point at Power Head the coordinates of which are 51° 47.1' North latitude and 8° 10.6' West longitude and a line drawn in true direction South from a point at Carnsore Point the coordinates of which are 52° 10.3' North latitude and 6° 21.8' West longitude. |

PART II. |
||
From Carlingford Lough to Carnsore Point between a line drawn in true direction South East from a point at Haulbowline Rock Lighthouse the coordinates of which are 54° 1.2' North latitude and 6° 4.7' West longitude and a line drawn in true direction South from a point at Carnsore Point the coordinates of which are 52° 10.3' North latitude and 6° 21.8' West longitude. |

EXPLANATORY NOTE. |
||
These Regulations implement the provisions of Articles 100 and 101 of the Treaty relating to the accession of Ireland to the European Economic Community which authorise the State to restrict fishing by vessels of other Member States in certain areas within the exclusive fishery limits of the State. |
