FOREIGN BIRTHS (AMENDMENT) REGULATIONS, 1985.

FOREIGN BIRTHS (AMENDMENT) REGULATIONS, 1985.

I, PETER BARRY, Minister for Foreign Affairs, in exercise of the powers conferred on me by section 27 (5) of the Irish Nationality and Citizenship Act, 1956 (No. 26 of 1956), as adapted by the External Affairs (Alteration of Name of Department and Title of Minister) Order, 1971 ( S.I. No. 158 of 1971 ), hereby with the consent of the Minister for Finance, makes the following Regulations:

1. (1) These Regulations may be cited as the Foreign Births (Amendment) Regulations, 1985.

(2) The Foreign Births Regulations, 1956 to 1981, and these Regulations may be cited together as the Foreign Births Regulations, 1956 to 1985.

2. These Regulations shall come into operation on the 1st day of January, 1986.

3. In these Regulations "the Regulations of 1981" means the Foreign Births (Amendment) Regulations, 1981 ( S.I. No. 259 of 1981 ).

4. The Foreign Births Regulations, 1956 ( S.I. No. 224 of 1956 ), as adapted by the External Affairs (Alteration of Name of Department and Title of Minister) Order, 1971 ( S.I. No. 158 of 1971 ), are hereby amended by:

(a) the insertion in Regulation 7 after "sixteen pounds" (inserted by Regulation 3 of the Regulations of 1981) of the following:

"in the case of the registration of a person under eighteen years of age and fifty pounds in the case of every other registration.",

and the said Regulation, as so amended, is set out in the Table to this Regulation,

(b) the insertion in Regulation 12 after "sixteen pounds" (inserted by Regulation 3 of the Regulations of 1981) of the following:

"in the case of the registration of a person under eighteen years of age and fifty pounds in the case of every other registration.",

and the said Regulation, as so amended, is set out in Table to this Regulation,

(c) the substitution of the following Regulation for Regulation 9:

"9. (1) Any person may obtain a copy of an entry in a foreign births entry book on payment of a fee of ten pounds.

(2) Any person may obtain a copy of the particulars in columns (1) to (6) of an entry in the foreign births entry book on payment of a fee to two pounds.

(3) Every copy of an entry, and every copy of the particulars set out in columns (1) to (6) of an entry in the foreign births entry book shall be authenticated by being certified to be a true copy of the entry, or of particulars of the entry, as the case may be, by a person authorised by or under these Regulations to make entries of births in the diplomatic mission or consular office, as the case may be, in which the book is kept.",

(d) the substitution of the following Regulation for Regulation 10:

"10. Copies of the particulars set out in columns (1) to (6) of each entry made in the foreign births entry book kept at a diplomatic mission or consular office shall, within six months of the date of the entry, be transmitted to the Department of Foreign Affairs by--

(a) in the case of a diplomatic mission, the head of the mission,

and

(b) in the case of a consular office, the head of the office.",

(e) the substitution of the following Regulation for Regulation 13:

"13. For each birth which is registered in a foreign births entry book, the particulars transmitted to the Department of Foreign Affairs in pursuance of Regulation 10 of these Regulations shall be entered in the foreign births register by a person authorised by or under these Regulations to make entries in the register.",

(f) the substitution of the following Regulation for Regulation 16:

"16. (1) Any person may obtain a copy of an entry in the foreign births register on payment of a fee of ten pounds.

(2) Any person may obtain a copy of the particulars in columns (1) to (6) of an entry in the foreign births register on payment of a fee of two pounds.

(3) Every copy of an entry and every copy of the particulars set out in columns (1) to (6) of an entry in the foreign births register shall be authenticated by being certified to be a true copy of the entry, or of particulars of the entry, as the case may be, by a person authorised by or under these Regulations to make entries of births in the foreign births register.".

TABLE

7. The fee to be charged for registration in a foreign births entry book shall be sixteen pounds in the case of the registration of a person under eighteen years of age and fifty pounds in the case of every other registration.

12. The fee to be charged for registration in the foreign births register shall be sixteen pounds in the case of the registration of a person under eighteen years of age and fifty pounds in the case of every other registration.

EXPLANATORY NOTE.

The purpose of these Regulations is to simplify internal procedures and:

(a) to increase the fee for Foreign Births Registration to £50.00 where the person to be registered is over 18 years of age;

(b) to introduce a simple form of certificate of entry, at a fee of £2.00, and

(c) to increase the fee for a full copy of the entry to £10.
