RULES OF THE SUPERIOR COURTS (No. 2) (Courts-Martial Appeal Court Rules (Amendment)), 2000

We, the Superior Courts Rules Committee, constituted pursuant to the provisions of the Courts of Justice Act, 1936 , section 67, and reconstituted pursuant to the provisions of the Courts of Justice Act, 1953 , section 15, by virtue of the powers conferred upon us by Courts of Justice Act, 1936 , section 68 (as applied by the Courts (Supplemental Provisions) Act, 1961 , section 48), and the Courts (Supplemental Provisions) Act, 1961 , section 14, and the Courts-Martial Appeals Act, 1983 , Section 23 and of all other powers enabling us in this behalf, do hereby make the annexed Rules of Court.

RULES OF THE SUPERIOR COURTS (NO. 2) (Courts-Martial Appeal Court Rules (Amendment)), 2000

1.   The following rule shall be substituted for rule 4 (1) of the Courts-Martial Appeal Court Rules (S.I. 206 of 1993).

“4.   (1)   Except as provided in sub-rule 2 every notice of appeal shall be served within twenty one days after the date of the promulgation of the confirmation of the finding and sentence of the trial court martial.”

2.   The words “twenty one clear days” shall be substituted for the words “14 clear days” where they appear in rule 8 of the Courts-Martial Appeal Court Rules.

3.   The Courts-Martial Appeal Court Rules (S.I. 206 of 1983), as so amended, shall be inserted as Order 86A of the Rules of the Superior Courts immediately after Order 86 thereof.

4.   This rule shall come into force on the 28th day of April, 2000.

5.   This rule shall be construed with the Rules of the Superior Courts, 1986 to 2000 and may be cited as the Rules of the Superior Courts (No. 2) (Courts-Martial Appeal Court Rules (Amendment)), 2000.

These Rules amend rule 4 (1) and rule 8 of the Courts-Martial Appeal Court Rules ( S.I. No. 206 of 1993 ).
