HOUSING

Injunctions Against Anti-Social Behaviour (Prescribed Premises) Regulations (Northern Ireland) 2003

  Made 15th September 2003 
  Coming into operation 1st November 2003 

The Department for Social Development, in exercise of the power conferred on it by Article 26(2)(d) and (e) of the Housing (Northern Ireland) Order 2003[1] and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation
     1.  - (1) These Regulations may be cited as the Injunctions Against Anti-Social Behaviour (Prescribed Premises) Regulations (Northern Ireland) 2003 and shall come into operation on 1st November 2003.

    (2) In these Regulations "the Order" means the Housing (Northern Ireland) Order 2003.

Prescribed premises
    
2.  - (1) The Department hereby prescribes accommodation held under non-secure tenancies from registered housing associations as a description of accommodation for the purposes of Article 26(2)(d) of the Order (power to grant injunctions against anti-social behaviour).

    (2) The Department hereby prescribes any private tenancy as a description of private tenancies for the purposes of Article 26(2)(e) of the Order (power to grant injunctions against anti-social behaviour).

EXPLANATORY NOTE

(This note is not part of the Regulations.)


Article 26 of the Housing (Northern Ireland) Order 2003 (power to grant injunctions against anti-social behaviour) allows the courts to grant, on application by the Housing Executive, a registered housing association or a private landlord, injunctions prohibiting a person from engaging or threatening to engage in anti-social behaviour in relation to certain descriptions of residential premises. Regulation 2 adds further categories of premises to which Article 26 applies.
