Breeding Flocks, Hatcheries and Animal By-Products (Fees) Order (Northern Ireland) 2004

  Made 29th March 2004 
  Coming into operation 26th April 2004 

The Department of Agriculture and Rural Development[1], in exercise of the powers conferred on it by Article 50(1) of the Diseases of Animals (Northern Ireland) Order 1981[2] and of every other power enabling it in that behalf, with the approval of the Department of Finance and Personnel hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Breeding Flocks, Hatcheries and Animal By-Products (Fees) Order (Northern Ireland) 2004 and shall come into operation on 26th April 2004.

Interpretation
    
2. In this Order -

Fees
     3. There shall be paid to the Department in respect of the transactions specified in column (2) of the Schedule the fees specified opposite thereto in column (3), such fees being payable within 14 days of demand.

Revocation
    
4. The Breeding Flocks, Hatcheries and Animal Protein (Fees) Order (Northern Ireland) 1994[5] is hereby revoked.

PAYMENT TO THE DEPARTMENT


NOTE -  the fees payable under the Breeding Flocks, Hatcheries and Animal Protein (Fees) Order (Northern Ireland) 1994 are shown in brackets.

3. Testing by the Department of composite faeces samples taken from breeding flocks under paragraph 5(1)(a) of, and paragraph 2(d) of Part I of Annex 2 to, the Breeding Flocks Scheme. £9·00 (£5·80)
4. Testing by the Department of samples taken from poultry in hatcheries under paragraph 7(1)(a) of, and Part II of Annex 2 to, the Breeding Flocks Scheme, in the case of -    
(a) a composite meconium sample;

  (b) the carcases of chicks dead in shell (up to a maximum of 50);

EXPLANATORY NOTE

(This note is not part of the Order.)


This Order repeals and replaces the Breeding Flocks, Hatcheries and Animal Protein (Fees) Order (Northern Ireland) 1994. It provides for fees to recover the full cost of transactions specified in the Order in respect of breeding flocks and hatcheries and for the purpose of authorising laboratories under the Poultry Breeding Flocks and Hatcheries Scheme Order (Northern Ireland) 1994 and approving laboratories under the Animal By-Products Regulations (Northern Ireland) 2003.
