The Department of Enterprise, Trade and Investment, in exercise of the powers conferred by Article 6(2) of the Cinemas (Northern Ireland) Order 1991[1] and now vested in it[2] and of every other power enabling it in that behalf, hereby makes the following Regulations:
Citation and commencement
1.
These Regulations may be cited as the Cinematograph (Safety) (Amendment) Regulations (Northern Ireland) 2004 and shall come into operation on 1st November 2004.
Amendment of the Cinematograph (Safety) Regulations (Northern Ireland) 1965
2.
- (1) The Cinematograph (Safety) Regulations (Northern Ireland) 1965[3] shall be amended in accordance with paragraph (2).
(2) In -
(a) regulation 8(1), for "twenty-one" there shall be substituted "eighteen";
(b) regulation 8(2), for "twenty-one" there shall be substituted "eighteen";
(c) regulation 31, for "twenty one" there shall be substituted "eighteen";
(d) regulation 36(7)(a), for "twenty-one" there shall be substituted "eighteen";
(e) regulation 45(1), for "twenty-one" there shall be substituted "eighteen".

EXPLANATORY NOTE
(This note is not part of the Regulations.)
1.
These Regulations amend the Cinematograph (Safety) Regulations (Northern Ireland) 1965 to lower the age from twenty-one to eighteen of:
(a) a licensee or a person nominated by the licensee to be responsible for the premises at all times when the public is on the premises (regulations 8(1) and (2) and 45(1));
(b) a person who is responsible for ensuring that electrical installations and equipment in the projection room are kept in good order (regulation 31); and
(c) a person in charge of and present in the projection room whenever inflammable film is being projected (regulation 36(7)(a)).

The declaration on costs and benefits relating to these Regulations prepared by the Department of Enterprise, Trade and Investment is held at the offices of the Health and Safety Executive for Northern Ireland at 83 Ladas Drive, Belfast BT6 9FR, from where copies may be obtained on request.
