SOCIAL SECURITY

The Housing Benefit (Permitted Totals) (Amendment) Order 2001

  Made 22nd March 2001 
  Laid before Parliament 27th March 2001 
  Coming into force 1st April 2001 

The Secretary of State for Social Security, in exercise of the powers conferred by sections 134(12) and 189(1) and (3) to (6) of the Social Security Administration Act 1992[1] and of all other powers enabling him in that behalf, after consultation with organisations appearing to him to be representative of the authorities concerned[2], hereby makes the following Order:

Citation, commencement and interpretation
     1.  - (1) This Order may be cited as the Housing Benefit (Permitted Totals) (Amendment) Order 2001 and shall come into force on 1st April 2001.

    (2) In this Order "the Permitted Totals Order 1996" means the Housing Benefit (Permitted Totals) Order 1996[
3].

Amendment of article 3 of the Permitted Totals Order 1996
     2. In article 3 of the Permitted Totals Order 1996 (increase in housing benefit) for "100.1%" there shall be substituted "100.025%".

Substitution of Schedule to the Permitted Totals Order 1996
    
3. For the Schedule to the Permitted Totals Order 1996 there shall be substituted the Schedule set out in the Schedule to this Order.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Housing Benefit (Permitted Totals) Order 1996 (S.I. 1996/677). This Order limits the amount by which housing benefit may be increased on the exercise of the discretion provided by regulation 61(2) and (3) of the Housing Benefit (General) Regulations 1987 (S.I. 1987/1971).

This Order does not impose a charge on business.
