Whereas a draft of these Regulations has been approved by resolution of each House of Parliament;
And whereas the Secretary of State has, in accordance with section 7(1) and (2)(e) of the Political Parties, Elections and Referendums Act 2000[1], consulted the Electoral Commission about these Regulations;
Now, therefore, the Secretary of State, in exercise of the powers conferred on him by the provisions which are specified in the Schedule to these Regulations, hereby makes the following Regulations: -

- (1) These Regulations may be cited as the Representation of the People (England and Wales) (Amendment) Regulations 2001 and shall come into force on the day after the day on which they are made.
(2) These Regulations do not extend to Scotland or Northern Ireland.

The Representation of the People (England and Wales) Regulations 2001[2] shall be amended as follows.

In regulation 3(1) (interpretation), for the definition of "data" substitute -
"
"data" means information which is recorded with the intention that it should be processed by means of equipment operating automatically in response to instructions given for that purpose;".

In regulation 47 (supply of free copies of register and list of overseas electors on request), after paragraph (1) insert -
"
(1A) For the purposes of this regulation "register" includes any revised version of the register under section 13(1) and (3) of the Representation of the People Act 1983[3] and any notice under sections 13A(2) and 13B(3) of that Act".
5.
In regulations 53(1) and 54(1), for "definite" substitute "particular".
6.
In regulation 56(5) (closing date for applications), for sub-paragraphs (i) and (ii) substitute "5 p.m. on the eleventh day before the date of the poll at that election".
7.
In regulation 60(2), for "defined" substitute "particular".

SCHEDULE
ENABLING POWERS
These Regulations are made under the following powers:
(a) sections 53[4], 201(1) and (3)[5] of, and paragraph 10B(1)(a) of Schedule 2 to, the Representation of the People Act 1983 ("the 1983 Act")[6];
(b) having regard to the definition of "prescribed" in section 202(1) of the 1983 Act and paragraph 1(2) of Schedule 4 to the Representation of the People Act 2000 ("the 2000 Act"), paragraph 3(2)(c) of that Schedule.
EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Representation of the People (England and Wales) Regulations 2001. They ensure that the provisions empowering the supply of copies of the register under regulation 47 extend to providing copies of any revised versions of the register and of notices published by registration officers in between the annual revision of the register. This is consequential on the introduction of the rolling register.
The instrument also contains other minor corrections to the Regulations.
