CORONERS

The Kent (Coroners' Districts) Order 2001

  Made 16th July 2001 
  Laid before Parliament 18th July 2001 
  Coming into force 1st August 2001 

Whereas the Council of the County of Kent have, in pursuance of section 4(2) of the Coroners Act 1988[1] and after due compliance with the provisions of the Coroners (Orders as to Districts) Rules 1927[2], submitted to the Secretary of State a draft Order providing for the alteration of the existing division of that county into coroners' districts;

     Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 4(2) and after taking into consideration objections to the draft made in the prescribed manner and within the prescribed time of that Act, hereby makes the following Order:

     1.  - (1) This Order may be cited as the Kent (Coroners' Districts) Order 2001.

    (2) This Order shall come into force on 1st August 2001.

    (3) This Order shall not have effect in relation to any inquest begun before the day on which it comes into force or to any post-mortem examination which, before that day, a coroner has directed or requested a medical practitioner to make.

     2.  - (1) The existing coroners districts of Ashford and Shepway, East Kent and Thanet (as constituted by the Kent (Corners' Districts) Order 1974[3] and amended by the Kent (Coroners' Districts) (Amendment) Order 1996[4]) of the County of Kent shall be abolished.

    (2) From the area of the coroners' districts referred to in paragraph (1) above, there shall be formed the coroners' districts of Central and South East Kent and North East Kent which shall consist of the areas specified in column 2 of the Schedule to this Order.

     3. Accordingly, the County of Kent other than that part of it included in the Mid Kent and Medway Coroner's District (as substituted by the Kent (Coroners) Order 1998[5]) shall be divided into three coroners' districts and each such coroner's district shall consist of the area specified in column 2 of the Schedule to this Order opposite to the name of the coroner's district in question as given in column 1 of that Schedule.

     4. The Kent (Coroners' Districts) Order 1974 and the Kent (Coroners' Districts) (Amendment) Order 1996 are hereby revoked.

North West Kent The Boroughs of Dartford, Gravesham and Tunbridge Wells; the District of Sevenoaks; and in the Borough of Tonbridge and Malling those parishes not within the Mid Kent and Medway coroner's district (as constituted by the Kent (Coroners) Order 1998).
North East Kent The City of Canterbury; the District of Thanet; and in the District of Dover, the parishes of Ash, Aylesham, Deal, Eastry, Eythorne, Goodnestone, Great Mongeham, Nonington, Northbourne, Preston, Ringwould with Kingsdown, Ripple, Sandwich, Sholden, Staple, Stourmouth, Sutton by Dover, Tilmanstone, Walmer, Wingham, Woodnesborough and Worth.
Central and South East Kent The Borough of Ashford; the District of Shepway; the District of Dover except those parishes within the North East Kent coroner's district; and in the District of Swale, the parishes of Boughton under Blean, Doddington, Dunkirk, Eastling, Faversham, Graveney with Goodnestone, Hernhill, Luddenham, Lynsted, Newnham, Norton and Buckland, Oare, Ospringe, Selling, Sheldwich Badlesmere and Leaveland, Stalisfield, Stone, Teynham and Throwley.


EXPLANATORY NOTE

(This note is not part of the Order)


The County of Kent was divided into six coroners' districts by the Kent (Coroners' Districts) Order 1974. One of these, North Kent was amalgamated with its neighbours so forming five different districts by the Kent (Coroners' Districts) (Amendment) Order 1996.

This Order creates two new coroners' districts out of the existing coroners' districts of Ashford and Shepway, East Kent and Thanet. The areas of those districts, named Central and South East Kent and North East Kent are set out in the Schedule to this Order. That Schedule also sets out the remaining coroners' district (North West Kent) which is wholly inside the County of Kent.
