In exercise of the powers conferred on the Secretary of State by section 69(5) of the Further and Higher Education Act 1992[1] ("the Act"), the Secretary of State for Education and Skills hereby makes the following Order:
Citation, commencement and application
1.
- (1) This Order may be cited as the Higher Education Funding Council for England (Supplementary Functions) Order 2001 and shall come into force on 2nd September 2001.
(2) This Order applies only in relation to England.
Additional function
2.
In addition to their other functions the Higher Education Funding Council for England[2] shall have power to administer on behalf of the Secretary of State any scheme established by her for the payment of grant under the Education (Grant) (Financial Support for Students) Regulations 2001[3] to the governing bodies of institutions within the further education sector (within the meaning of section 91(3) of the Act).

EXPLANATORY NOTE
(This note is not part of the Order)
This Order, which comes into force on 2nd September 2001, confers an additional function on the Higher Education Funding Council for England. The function conferred by this Order is the function exercisable in connection with the Education (Grant) (Financial Support for Students) Regulations 2001.
