The Education (Mandatory Awards) (Amendment) (No. 2) Regulations 2004

The Secretary of State for Education and Skills, in exercise of the powers conferred by sections 1 and 4(2) of, and paragraphs 3 and 4 of Schedule 1 to, the Education Act 1962[1], and by section 3(1) and (3) of the Education Act 1973[2] hereby makes the following Regulations:

     1. These Regulations may be cited as the Education (Mandatory Awards) (Amendment) (No.2) Regulations 2004 and shall come into force on 1st September 2004.

    
2. In paragraph 13(1) of Schedule 2 to the Education (Mandatory Awards) Regulations 2003[3], for "£2,280" substitute "£2,335."

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Education (Mandatory Awards) Regulations 2003 (S.I.2003/1994) as amended by the Education (Mandatory Awards) (Amendment) Regulations 2004 (S.I.2004/1038).

These Regulations increase the payment rate of dependants requirement for students from £2,280 to £2,335. Regulation 6(3) of the 2003 regulations provides that the increase shall only apply in relation to an academic term which commences on or after the 1st September 2004. Where an academic year starts before 1st September 2004, but ends after 1st September 2004, the old payment rate and the new payment rate shall be applied proportionally.
