The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980[1] and now vested in him[2], and of all other powers enabling him in that behalf:
1.
This Order may be cited as the A2/A282 Trunk Roads (M25 Junction 2 Improvement) Slip Roads Order 2004 and shall come into force on 21st October 2004.
2.
In this Order -
(i) "the A2 Trunk Road" means the London - Dover Trunk Road (A2);
(ii) "the A282 Trunk Road" means the Dartford Tunnel Southern Approach Road (A282);
(iii) "the new trunk roads" means the slip roads;
(iv) "the slip roads" means the new highways which the Secretary of State proposes to construct along the routes described in the Schedule to this Order and which connect the A2 Trunk Road with the A282 Trunk Road at Junction 2 of the M25 motorway; and
(v) "the plan" means the site plan contained in the plan folio numbered HA 10/OD/482, marked "The A2/A282 Trunk Roads (M25 Junction 2 Improvement) Slip Roads Order 2004", signed by authority of the Secretary of State for Transport and deposited at ODPM-DfT, Records Management Branch, Floor 13, (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.

The slip roads shall become trunk roads from the date when this Order comes into force.

The centre line of each of the slip roads is indicated by a heavy black line on the plan.
5.
The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunk roads that -
(a) where the highway is maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority, and
(b) where the highway is not so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,
until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for traffic.

SCHEDULE
ROUTES OF THE SLIP ROADS
The routes of the slip roads are at Dartford in the Borough of Dartford in the County of Kent and are as follows:
(a) a route (given the reference numbers 1 and 3 on the plan) to connect the eastbound carriageway of the A2 Trunk Road with the northbound carriageway of the A282 Trunk Road;
(b) a route (given the reference number 2 on the plan) to connect the existing A2 roundabout at the A2/M25 interchange (M25 Junction 2) with the northern part of the existing A282 northbound slip road to the Princes Road interchange (Junction 1B);
(c) a route (given the reference number 4 on the plan) to connect the northern part of the existing A282 southbound slip road from the Princes Road interchange (Junction 1B) with the existing A2 roundabout at the A2/M25 interchange (M25 Junction 2);
(d) a route (given the reference number 5 on the plan) to connect the southbound carriageway of the A282 Trunk Road with the eastbound carriageway of the A2 Trunk Road; and
(e) a route (given the reference number 6 on the plan) to connect the westbound carriageway of the A2 Trunk Road with the northbound carriageway of the A282 Trunk Road (via the route given the reference number 3 on the plan referred to at sub-paragraph (a) above).
